Allegations made and evidence are opposites... is my attorney crazy?

I’ve been dealing with a custody battle where my ex filed an Emergency Custody Application with 36 allegations against me and my spouse. The judge seemed to favor my ex initially, and my children were taken from me and put under supervised visitation. After getting a lawyer, we found out that 100% of the allegations were false. My attorney has told me multiple times that this case is absurd. However, my ex has submitted a lot of evidence, including tax returns and a Google doc of times I was late picking up the kids. I feel like I’ve been losing repeatedly and I’m starting to doubt my attorney’s judgment. Am I crazy for feeling this way?

It sounds like your ex has no real evidence to support his claims. Your attorney seems to be confident that the evidence presented is mostly hearsay. Trust your attorney, as they know the legal landscape better than you do.

I trust my attorney, but I feel disconnected because they seem to think my case is nonsensical. I wish they would spend more time explaining the process to me.

I can relate to your situation. I recommend asking for a 730 evaluation. It can provide a more in-depth look at both households and the children’s well-being. Trust the process and your attorney’s advice.

I had only about 15 minutes to plead my case in front of the judge. I mentioned that there was no CPS report, but the judge dismissed it, saying the allegations were serious.

It’s tough when judges don’t consider all evidence. Just keep your focus on the facts and let your attorney handle the legal arguments. You’ve got this.
