Any advice for moving with my son would be helpful

I want to leave this man and move back to Illinois where my family is, but I’m worried about the legal implications since we have a child together. We’re not married, but I signed some paternity paperwork when our son was 6 weeks old. I’m unsure what it said. Is it legal for me to leave the state without court permission? Should I contact lawyers in both states? How does custody typically work in these situations, especially with a 2.5-hour distance? I’m terrified of leaving and even more scared of my son being alone with him for extended periods.

You should definitely file an emergency petition and consider getting an order of protection. If you need to leave quickly, a domestic violence shelter can help. I wouldn’t recommend moving without court approval, as that could complicate things later.

I tried that before, but the clerk said I’d have to wait four days for a court date, and I can’t stay with him after serving him papers. I didn’t file anything then.

No, you don’t have to let him know. It won’t look bad for you if you’re in a safe place.
