Can a 12 year old refuse visitation in Texas?

Hi folks, Quick question: If a 12-year-old in Texas doesn’t want to go on a visit with a parent, can they refuse? :woman_shrugging: What’s the process or rules around this? I’m trying to figure out how these decisions are handled legally. Any thoughts or experiences?

In Texas, a 12-year-old’s preference regarding visitation can be considered, but it’s not decisive. The court prioritizes the child’s best interests, so a child’s wishes are just one factor among many.

There’s no fixed age in Texas when a child can automatically decide to stop visitation. Courts look at factors like the child’s age, maturity, and what’s best for them. It’s important to seek professional legal advice in these situations.

There has to be a significant change in circumstances for a modification. Kids do not get to decide. A judge may ask their preference but they generally do not order no visitation unless there is abuse. The preference is usually who do you want to live with, not do you still want to see your parent.

Generally, no. After a certain age (typically 12-14ish), children can provide feedback and discuss their preferences. But it is not their decision to make.
