Can i get in trouble for taking my furniture back?

So, I took my furniture back from my ex’s place (it’s under my name, btw) and now he’s filing a civil suit against me. He’s also saying I physically assaulted him, which is crazy because I wasn’t even home. There’s a hearing soon, and I have proof of ownership. Just wondering… what should I expect at the hearing? And can the judge really make me give the stuff back if I’m still paying for it?

If the furniture is under your name and you’ve got proof, you should be fine. Bring receipts or any documents showing you’re paying for it.

Thanks! I’ve got all the payment proof. Do you think the judge could still make me give it back though?

It’s unlikely if you have solid proof. The judge would probably decide based on who can prove ownership best.

Wait, what’s a civil suit exactly? Does it mean he’s pressing charges or something?

Nah, a civil suit just means he’s asking for money or the furniture, not criminal charges. Totally different.

Oh, got it. Thanks for clearing that up!

About the assault thing… if you weren’t home, you can prove that, right? Maybe with texts or an alibi?

Yeah, I’ve got proof I wasn’t even there. Hopefully, that clears things up.

You should be good then. Just stick to the facts and stay calm at the hearing.

If the furniture’s included in the lease, how does that work? Like, does it count as yours if you’re paying for it?

Good question! It’s part of the amenity fee I’m paying, but I’m not sure how that affects things legally.

Sounds like you’re still the owner if it’s under your name. Judges usually care about payment records more than lease stuff in these cases.

For the hearing, just be ready to explain everything clearly. Bring your receipts and any evidence for the assault claim.

Will do! Thanks for the advice. Hoping it goes smoothly.

No worries. You’ve got this. Just stay calm and stick to the facts.
