Ex's income went up... he wants a modification to lower support?

I could really use some advice here. So, my ex’s income has gone up quite a bit—like adding $10,000 to what he makes. His job doesn’t offer insurance, and he makes way too much to qualify for any assistance. Our daughter had Medicaid until the end of October because of my income, but I had to add her to my insurance after that. Now, he has to pay me more because she lost Medicaid. On top of the child support, he’s responsible for half of her medical costs. Just to give you an example, she went to urgent care a couple of times in November, and we ended up owing about $360 for an allergist visit since she has a confirmed shellfish allergy. The total he owes me for that month came to $202. I sent him all the receipts, including proof of my insurance premium. He’s not thrilled about the extra costs, but honestly, we have a toddler who needs a lot of medical care.

That sounds really tough. Has he actually filed for a modification yet?

Not yet, but he says he’s going to take me to court. I don’t really get why though.

It seems wild that he thinks he can get out of paying. I mean, you’re just doing what’s best for the kid.

Totally agree. Plus, if his income went up, that’s not a good reason to lower support.

I’d document everything. If he tries to take you to court, you’ll want to show how much time you have her.

Yeah, I can definitely prove that. I have her more than the 60-40 agreement says.

It sounds like he’s just trying to avoid responsibility. The court usually looks at the best interest of the child.

Exactly, and I’m worried about what he thinks he can accomplish. It feels like he’s just frustrated.

Is there a chance he could get out of paying? Seems unlikely if he’s making more now.

Honestly, I don’t see how he could. The judge would probably look at his increased income.

Right? Plus, you’ve got proof of all the expenses. That should help you a lot.
