Background & Question: Ex’s lawyer withdrew from the case holding out trust funds in escrow (September 2024), new attorney enters on the same date. Fast forward to present… new attorney still doesn’t have our trust funds in escrow, they are still with the previous attorney 5-6 months later. Is this a violation? Shouldn’t funds be transferred right away to the new attorney taking the case? I’m so mad. We settled our case, but it’s been a month since court and we still don’t have our funds.
It sounds frustrating. Typically, when an attorney withdraws, they should transfer any funds held in escrow to the new attorney promptly. You might want to consult your current attorney about this delay and see if they can reach out to the previous attorney to expedite the transfer.

I really hope they can sort it out soon. It’s just unacceptable to wait this long after settling.

I completely understand. It can really feel like you’re in limbo while waiting for funds that should rightfully be yours. Keeping open communication with your current attorney is key.
