How can I know if my complaint meets fraud qualifications?

Another mother and I sent a complaint to the IL ARDC. It included 25 incidents. Would it be possible for you to review and determine if any meet the 5 qualifications of fraud?

Fraud in legal cases is tricky. To prove fraud, you need 5 key things: a false statement, knowledge it’s false, intent to deceive, reliance by the victim, and harm. Are any of the incidents you mentioned showing that? I’d say break down each incident to see if it checks these boxes.

Each of your incidents should be looked at individually. If any involve the lawyer knowingly making false statements, that could be a start. Then if you can show how those false statements affected your case, that would help. Did any of the incidents include clear lies or misleading actions?

It’s good that you have 25 incidents to work with. Try to match them to the fraud elements, like if any statements were proven false or if you lost money based on those statements. That’ll strengthen your complaint.

Yeah, but if there’s no clear damage, it could be harder to prove fraud. Did the false statements actually cost you anything or hurt your case?

Sounds like you’re on the right track. Just be sure to show how the lawyer’s actions led to harm. If you can, back up everything with documents or emails. That way, it’s clear the fraud was intentional.
