How do I start the process to get full custody of my kids?

I’m in Washington State and want to file for full custody of my two kids. Their mom moved to Hawaii a year ago and has been trying to stop me from seeing them. She doesn’t have stability—she moves from house to house, doesn’t have a job, and parties all the time. I’m really concerned about their well-being and just want to make sure they’re safe. Where do I even start with this?

The first step would be filing a Petition for Child Custody in the state where your kids currently live. Have you done that yet?

Not yet. Honestly, I don’t even know where to start, and it feels overwhelming. Any advice?

Totally understandable. You’ll need to file in Hawaii since that’s where your kids live now. Maybe start by contacting a local lawyer there.

Since you’re on the birth certificate, you have legal standing to file for custody. Do you have any evidence of her instability?

I don’t have a ton of evidence, just what I know about her lifestyle. Would that be enough?

It helps if you can gather things like text messages, social media posts, or witness statements. That’ll strengthen your case.

It’s great that you’re stepping up for your kids. Have you thought about hiring a lawyer to guide you through this?

I’m willing to spend all my savings to hire a good lawyer. I just want what’s best for my kids.

@Aubrey
That’s the right mindset. A lawyer can help you navigate everything and make sure your concerns are clearly presented to the court.

Courts usually prioritize the kids’ best interest. Do you have a stable environment to offer them?

Yes, I have a steady job and a safe home. I can provide for them without any issues.

@Aubrey
That’s perfect. Make sure you emphasize that during the custody process. Stability is a big factor for the courts.

If she’s threatening to keep the kids away, document that too. Courts take alienation attempts seriously.

Good point. I’ll start keeping track of everything she says and does that might show that.

@Aubrey
That’s a smart move. The more evidence you have, the better. Best of luck with everything!
