How does retroactive child support work in Florida?

I’m trying to figure out how retroactive child support works in Florida. So, is it calculated and added on top of what the paying parent already owes? My ex has been absent for two years, and catching up will be a lot since he’s not contributing at all. He makes way more than I do, but it feels like he’s just wasting it all. Honestly, I doubt he’ll make any payments.

From what I know, they set a monthly amount first. If he owes, say $1000 a month, and then they find he’s 6 months behind, he’ll pay an extra amount on top of that until he’s caught up. So like $250 extra each month.

@Cai
That makes sense. So he’d basically be paying off his debt along with the regular support? Sounds tough.

Exactly! It can add up. You might want to check with someone who knows the process well, though. Just to be sure.

I think the Department of Revenue can automatically withhold payments from his income if he’s not paying. They have some strict rules about it.

Right, I heard that too. If he misses payments for 90 days, he might get his license suspended. That should motivate him, at least a little.

@zam
Definitely. But also, do you think I can just get his wages garnished? Like, I don’t want to keep asking him for money.

Yeah, they can garnish his wages, especially since he has W2 jobs. That way, you’ll get regular payments without having to chase him down.

Wow, sounds like a real headache. Just curious, what do you mean by ‘W2 jobs’? Is that important?

Oh, it just means he’s getting paid through a regular employer. They take out taxes and stuff, so it’s easier to track his income for support purposes.

Ugh, I feel for you. It’s frustrating dealing with someone who’s not taking responsibility. Have you thought about getting a lawyer to help with all this?

Yeah, I’m considering it. I just want to make sure I’m doing everything right. This whole thing is overwhelming.
