How important is therapists opinion?

Ex essentially failed reunion plan. After 6 years of little communication, he’s now interested in fighting for custody. He has repeatedly asked our child about custody matters, canceled visits last minute, and even mentioned adoption by my husband before changing his mind. Our child has been seeing a great therapist for over a year, who wrote a letter stating that the child’s anxiety is heightened by my ex and that the child is not benefiting from the relationship. How much will this help our case? I already have full physical custody and would like to obtain full legal custody and end visits until he’s evaluated. We go back to mediation in a few weeks.

Therapist opinions usually hold a lot of weight in court. You should ask your lawyer about the specifics in your district.

As a NC family law attorney, I recommend asking the therapist to testify or subpoenaing them. Insights from children’s therapists are strongly considered by judges.

The therapist has already offered to help! The letter is for mediation to explain my requests to my ex.

That’s great! The letter will be a useful tool in mediation. I hope you achieve the resolution you seek!

Depending on your judge, the letter may not be admitted. You may need to subpoena the therapist to testify.

Thank you for the insight! I appreciate it!
