I got laid off at the worst time! Child custody battle coming

Hi there, my ex-husband scheduled a custody conference because he wants to be the primary caretaker. Right now, we have a 50/50 legal and physical custody arrangement, which has been in place for 2 years. I’m not worried about the conference since I have evidence of parental interference, alienation, medical neglect, and high conflict co-parenting. However, I just got laid off unexpectedly! I had a stable WFH job, and now I’m afraid he’ll use this against me, claiming I’m unstable. I want to change careers from HR to nursing and need some time to get my certifications. Can he really argue that I’m unstable because I’m not working? I’ve also filed for unemployment and SNAP to support my family of four.

If you have evidence of alienation and neglect, why not file a counter motion? You can’t just wave papers around during the hearing. Get legal advice and file back.

He can’t use your job status against you. In fact, some people try to use this to their advantage. Judges usually impute income, so it won’t count against you.

They won’t take your child away just because you don’t have a job. As long as your child is cared for and has basic needs met, you’re fine. Going back to school is a positive thing.

You can frame it as having more time to care for the kids since you’re not working right now. Courts care more about food and shelter than your job status.
