Hey everyone, I have a bit of a unique situation. I know this is a morbid thought, but I often wonder what would happen if I were to pass away. My mom died when I was 2, and my dad remarried when I was 3, but then he passed away when I was 8. I ended up with my stepmom. Now I’m in Idaho, and I’m curious about how custody works here. I have two kids from before I met my husband; their biological dad has been out of the picture since they were born, and he never signed the paternity affidavit, so he’s not listed on their birth certificates. If something happened to me, will my husband automatically get custody of them? I want him to have it, and he treats them like his own. We also have a younger child together, so I know he would get custody of him. Just wondering what happens since I don’t have a will set up. Thanks in advance!
That’s a tough situation! I think it really depends on Idaho laws. You might want to look into getting a will set up, just to be safe.
In Idaho, if the biological father isn’t listed on the birth certificate and hasn’t been involved, your husband might have a good chance of getting custody. But seriously, get a will ASAP.

Thanks for the info! I guess it’s time to talk to a lawyer about setting something up.
I went through something similar. When I passed, my husband got custody of my kids because I had everything documented. Definitely look into it!
You should also consider a guardianship plan. That way, if something happens, your wishes are clear. It’s super important.
I’d say getting a will is crucial. You want to make sure everything is set up the way you want it, especially with kids involved.
