My soon to be ex-husband is ignoring my emails in regards to childcare expenses. We have an outstanding daycare and after-school bill that needs to be paid as soon as possible. He has not filed for divorce yet and plans to leave our marital home on his free will. Is he still responsible for paying half of our child care expenses and marital expenses? What happens if he does not pay?
It really depends on your situation. If you don’t have a court order yet, he might not be legally bound to pay right now, but once the divorce is filed, you can ask for him to pay. Best thing is to file for divorce and include requests for child support and spousal support.
I think he’s still responsible, but without a court order, it’s hard to make him pay. Make sure you document everything for when the court steps in.
When you file for divorce, you can include petitions for both child and spousal support. The court can make him pay back the expenses once it’s ordered, but until then, it might be tough to force him.
Once you file the divorce and petition for support, the court might make him reimburse you for what you’ve paid, depending on the judgment. Just keep all your receipts for now.
Sorry to hear you’re going through this. Yes, you can ask the court to order him to reimburse you for those expenses once you file. Keep track of everything and file as soon as you can.
