My daughter was held back last year in school, and my ex keeps her home from school just because she doesn’t feel like taking her. This is a crime in Virginia, and I think it’s a violation of our joint legal custody order. Should I file a show cause? There’s already a show cause against her, and I’m wondering if I should add this to show more non-compliance with our order.

Nobody really cares about 3 days in a school year. But again, why was she held back?

She was held back for failing every test gate.
Most schools have a grace period for absences. Are we talking about 3 days of the current school year or last year?

We’re talking about 3 days so far this year.
If it’s just a few days here and there, you might just annoy the court. Try keeping a record of missed days compared to who had custody. A big difference in absences could help your case.

The point is to show that she doesn’t regard the joint legal custody and tries to cut my parenting time.
Keeping a child home during your custody time isn’t a joint decision. There must be more to this situation?

It’s a crime to keep her out of school without a medical or emergency reason in Virginia.

It’s pretty much illegal everywhere. Kids are required to be in school, but they can miss a certain number of days. Have they exceeded that number?

She is on her second show cause and has spent years denying my parenting time. The court told me to file for every violation.

Yes, I filed for a change of custody, but the court said it was her first violation and the order wasn’t clear enough. Now she’s violating again, and I want to add this to my existing show cause.

She was Title 1 for performance and then held back. I’m calling the school tomorrow about this issue.
