Hey guys, my SO is currently dealing with a custody battle and has an HCBM (Conflict Bio Mom). Today, during the hearing, she denied ever going against their parenting agreement. My SO mentioned he had screenshots, but the judge said, ‘I’m not going to waste time reading text.’ Then, the judge turned to HCBM, giggled, and sarcastically asked, ‘Are you following the parenting plan or do I need to read those texts?’ This feels unfair. Is there any way to hold the judge accountable for this or at least get a new judge? Thanks for any advice.
That sounds really frustrating. Have you considered filing a complaint about the judge’s behavior? It might not guarantee a new judge, but it’s worth documenting.
I’m not a lawyer, but usually, you can request a recusal if you feel the judge is biased. It might require showing evidence of the bias, though.
I’d definitely recommend talking to a family law attorney about this. They can guide you on the best steps to take.
Judges should remain neutral, and it sounds like that wasn’t the case here. Document everything and consider bringing it up with your attorney.
I had a similar situation before. It’s tough, but making sure your SO has a solid representation can help. Good luck!
