[Pa, Ky] requesting visitation and custody of a child

Trying to help my cousin. He was in the army, got married, had a kid, and then split up. The mom has been living in Kentucky with the kid for the last few years, while the dad is in PA. They’re divorced but have no custody agreement. He believes he can’t file for custody or visitation unless he lives in Kentucky for 6 months. He just wants to have his son for a week or two during the summer. Should he contact a family lawyer in Kentucky to start the process, or does he need to live there for 6 months first? Any advice on how to proceed would be helpful.

The six-month filing period applies to the child’s residence, not his own.

If there is:

A. There is currently no custody order from any court. B. And the youngster has lived in Kentucky for at least six months.

The father can then seek for custody in Kentucky. It does not matter where the father lives.
