Our agreement states ‘school breaks 3 days in length and longer’ are my time. If our child has Friday and Monday off school, resulting in a 4-day weekend, would you agree that means it’s my time? Or would you think it’s 3 school days in a row?
What an odd statement to have in a custody agreement. It becomes very tedious and confusing. What does Christmas break look like? Easter break? Other ‘week’ long breaks? What about summer? If it were me, I would assume this meant ‘school breaks’ not weekends. Weekends are not ‘school breaks.’
Yeah, I don’t believe including weekends. 6 hours of driving for three nights? It doesn’t make sense.
It’s in there as we live 6 hours from each other. I have her for summer, winter break, spring break, etc., but I can also take anything 3 days in length or longer. Ah, see it feels like a gray area. I’m getting both opinions.
Yes. Anything over 3 days is your time. It doesn’t say 3 school days; it says 3 days. That includes weekends.
I think it’s a bit ambiguous, but if the agreement is open to interpretation, you might have a stronger case for claiming the long weekend as your time. Document everything just in case it needs to be clarified later.
