Hello! I am wondering what rights my friend’s mother has to her grandchildren. My best friend and her 2 babies tragically passed away. They have 2 different dads; the 5yr old’s dad abandoned him, and the mom gave up his rights; he was never in his life, and once he passed away, he took his body. The 5-month-old, his father took his life before he was born, and his mom took him. I feel like it’s wrong, separating them. I feel like they don’t have the rights, but I’m not sure legally where they stand and where my friend’s mom stands as the maternal grandmother. I just need advice…
This is absolutely none of your business. Stop harassing grieving families.
You might have better luck posting in this forum or forum because this isn’t really a family law question. If you post elsewhere, I recommend simplifying your question to something like: who is entitled to the remains of minor children when their mother is deceased? Then you can explain that one dad is also deceased and the other dad is uninvolved. You should also include whether paternity was legally established for either of the kids
Others have tried to help by explaining to you that your post is poorly written and difficult to understand. You have chosen not to accept that feedback. I’ll do my best. If the mother of both children died, as well as the children, the fathers of those children would have the right to claim their bodies. If paternity was never established or if there is some dispute as to paternity, this could complicate the matter.

If the children have died, what is your friend wanting exactly?

The closest living legal relative has rights to the body. If one parent is dead, then rights to the body go to the next living parent. If the Mother caused the death in any way and the Father is deceased, rights would likely pass to the paternal family than the maternal side, since she was involved in the death. It would be similar if the Mother had her rights terminated to the children but it’s very hard to make sense of who had custody of the children with the way your formatted the post.
