Should this judge step down… or am I overthinking?

We have a custody hearing coming up for my grandson, and the judge used to be a prosecutor. Back then, he handled a case against my grandson’s grandfather. I also confronted him about the grandfather bringing his daughter (the child’s mom) along while serving legal papers and even during an arrest.

Should he remove himself from the case?

I doubt he remembers me, but he’ll definitely remember the mess with the grandfather. I have no clue if that would make him biased for or against us, but just knowing the names involved might make him act differently. He’s not exactly the best judge either, so I don’t have much faith in how this will go.

In Texas, there are rules about when a judge has to step down. If they were involved as a lawyer in the same case or worked with a lawyer who was, you can ask for disqualification. But from what I’ve seen, these requests don’t get approved very often.

Some states let you request a new judge once without having to give a reason. Indiana has that rule, but I don’t know if Texas does. Might be worth checking into, or even asking a lawyer for advice on this.

I have a lawyer, and she’s not a fan of this judge either. If she thought we could get him removed, I think she would’ve said something. I’ll make sure she knows about my past dealings with him, though.
