Soon to be ex husband might not be using monitor for visits

Hi, so I’m in California. My STBXH lost all of his parental rights to our children and has been granted supervised visits. The problem is the monitor for these visits is his father and I don’t believe his father has been monitoring these visits lately. What would be the next course of action? For the record, this is court ordered supervision and it is crystal clear who the monitor is and that he’s supposed to be monitoring ALL visits.

Can you get professionally supervised visitation? Ask your attorney about it.

Guardian ad litem might help. Tell the judge you can’t trust your ex’s father. My ex wanted to use his mom but we said no because she’s just as bad!

Have your lawyer look into it & make any necessary changes!

Why do you believe his father is no longer monitoring these visits? If the order is recent, how do you know he’s not there?

I’ve actually considered this. Our son has said my FIL wasn’t present, but I don’t think telling him what our son said is safe for my son.

If your ex has supervised visitation, he still has parental rights. The judge just imposed conditions. You should release the kids to the monitor, not your ex. Bring your court order to school if needed.

This is exactly it. I think it’s like a bait and switch as of lately.

The visits aren’t going well if he’s in contempt. Show proof of him not following the order, and it could help you a lot.

I do the transfer directly with my FIL at a neutral location. He’s supposed to be there for the entire visit.

Making the parent’s own father the monitor seems like an absolutely crazy idea. I’d contact your lawyer to discuss getting the monitor changed.
