Washington state name change

My stepson is four years old, and his biological father hasn’t been involved in his life at all during that time. He’s also facing jail time soon. I’m married to his mom, who has full custody.

In Washington State, I have heard that a stepparent might not need the biological father’s consent to change a child’s last name. However, I’ve gotten conflicting information and some lawyers are charging a lot just for a consultation.

Can anyone clarify the situation in Washington? Would I legally be able to change my stepson’s last name without needing the biological father’s consent?

In Washington State, you can often change your stepson’s last name without the biological father’s consent if he’s been absent and hasn’t supported the child. You need to file a petition, possibly notify the father, and attend a court hearing. The court will decide based on the child’s best interests. Legal advice can help, and some resources are available for free or at low cost.
