What happens if mother refuses to take court ordered paternity test?

I’m currently going through a paternity court case in Hawaii. I’m the legal father but didn’t have custody due to issues with the mother. She’s fled the state multiple times and has been avoiding court proceedings. Recently, the judge ordered a paternity test, but the mother is refusing to comply, even after being served. I’m worried about what the judge will do about her non-compliance. Does anyone have experience with this type of situation?

If the court has ordered the test, she is required to comply. If she doesn’t, she could be held in contempt, and they might stop your payments to her until she complies.

Yeah, but given her history of moving around and not showing up, she might just ignore it and move again. I doubt they’ll issue an out-of-state warrant for her.

That’s what I’m worried about. It feels like she can just keep dodging this.

Hopefully, the court will let you stop paying child support until she takes the test.

You should definitely ask to terminate the child support or have it paused until she complies with the test. It seems fair given the circumstances.

I’d recommend keeping all the evidence you have regarding her non-compliance. It might help your case if it comes down to it.
