Wife filed false accusations with DSS

My wife and I are getting divorced, and she’s trying to show the courts that I’m abusive, which is entirely false. She opened a DSS investigation regarding our children’s behavior and claimed it was my doing. DSS conducted their investigation, and all accusations were found to be “unfounded.” What does that mean for me? She risked having our children taken into CPS based on lies to discredit me in court. Are there any repercussions for her actions, and what can I do?

You could potentially sue for slander, but that would be a different area of court. Keep a paper trail of everything, including the CPS paperwork. Judges appreciate solid documentation.

Unfortunately, there may not be actual consequences for her. After repeated false claims, the court might lose patience, but you definitely need a lawyer to help navigate this. You also need to focus on co-parenting for your kids’ sake, even if it’s difficult.

Unfounded means they didn’t find evidence of abuse, so that’s a good sign for you. You can request the report for court, and it might provide useful information.
