I’ve filed for dissolution of partnership and my partner wants to quit claim his interest in the house to our daughter before her wedding in November. The thing is, she doesn’t want the house in her name, and I’m wondering if Lis Pendens would stop that quit claim from being processed? Anyone know how this works?
I think the Lis Pendens could make things tricky. It basically alerts anyone that there’s a legal dispute going on, so it might mess with the transfer of the property title. It’s worth discussing with your lawyer.

Yeah, I’ve heard that too. It might not totally stop the deed, but it could make it harder to get clear title. You might need a special agreement.

So, you’re saying it could be done if we get a special agreement to clear the Lis Pendens for just this transfer? That would work?
It sounds like you need to get the Lis Pendens modified or temporarily removed to make sure the quit claim can go through smoothly. Maybe your lawyer can help with that?

The trust’s terms might also play a role here, since your partner’s interest in the house came from it. Definitely something to check with your lawyer to figure out the best way to handle it.

Right, he got his part through the trust, so I guess there’s more to think about there. I’ll make sure to bring that up with the lawyer.
One option could be getting an agreement that specifically lets the quit claim go through while keeping the Lis Pendens for other matters. I’ve seen that happen in some cases!
