I’ve filed for dissolution of partnership and my partner wants to quit claim his interest in a house to our daughter before her wedding in November. The issue is that there’s a Lis Pendens in place due to the dissolution. Will this stop the quit claim from going through? My daughter doesn’t want the gift, but if this Lis Pendens thing is blocking it, I need some clarity on options.
Yeah, I had a similar situation before. The Lis Pendens could complicate things because it puts a cloud on the title. It might stop the transfer if it’s not handled right.

So what can you do about it? Like, can you remove it temporarily or something?
@Grace
Exactly! You can potentially get a temporary stipulation or court order to remove the Lis Pendens just for the quit claim. It won’t remove it entirely, just for that specific transfer.
I think the best move here is negotiating with your partner or their lawyer to reach an agreement. That way, your daughter can get the house without any title issues.

Yeah, you really need that agreement in writing or you might run into problems later on.
What is Lis Pendens, btw? I don’t really get what it means for the property transfer?

It’s basically a notice that a legal dispute is ongoing over the property. It can make transferring the property tricky because it warns anyone interested in buying or financing that there’s a legal issue with the title.
If you’re in a rush, maybe talk to your lawyer about getting a temporary agreement just to get things moving before the wedding. It could help avoid delays.

Good idea! You might be able to finalize it faster if everyone’s on board.
If she accepts the gift, this could work out well. The Lis Pendens could be lifted just for that transfer, and it’ll clear up things for the future.
