I’m not sure what you mean by “common law divorce.” Texas recognizes common law marriage, but the divorce process is the same for common law marriages as it is for formal marriages. If there’s a question about the validity of the marriage, it can complicate things, but there’s no separate process for divorce itself.
If there’s any chance of working it out, consider the dispute resolution center for help. In high-conflict custody cases, the same few lawyers are often recommended, and they tend not to be cheap or flexible.
