Can I sue my stb ex spouse for spending 40k...?

Hey folks, I need some advice about my situation. I was deployed when my soon-to-be ex-filed for divorce without telling my parents. She moved in with them to pay off debt and promised she would handle it. We figured it would be around $34k paid off, but when I got back, no debt was cleared, and my account was in the negatives. Can I bring this up in the divorce? Can I just give her all the debt? Also, she kind of abandoned our kids to party and left them with her mom, who isn’t exactly a good influence. What’s the threshold for unfit parents in Colorado? Thanks for any help.

IANAL, but get a lawyer for sure. You won’t need to sue; it’ll all come up in the divorce. Her emptying your account won’t look good.

There is a way. During the property settlement, if there are more assets, you can reduce her share by $20k. That $40k was a marital asset, so she should pay you back for that.
