Hey guys, I just had a really tough situation with my ex-wife regarding our kids. My 13-year-old daughter felt unsafe at her mom’s house and even texted my sister to come pick them up. It’s been really stressful because my ex has a history of mental health issues, and the kids are worried about her behavior. I’m just trying to figure out the best way to keep my kids safe without making things worse. Anyone have advice?
Wow, that sounds really difficult. In most places, you can ask for an emergency order of protection. I’m not a lawyer, but I’ve heard keeping records of everything is super important. If she’s not following the parenting plan, that could work in your favor. Just make sure to document everything.
@Koa
What do you mean by documenting everything? Like, text messages and stuff?

Yeah, exactly! Texts, calls, even dates of incidents. It all counts.
I totally get it. Protect your kids first, no matter what. Document everything. Courts usually want to see that you’re looking out for their safety. It’s tough, but you’re doing the right thing.

It’s hard to know if she’s really not compliant or just having a rough time. Could be both, you know?
What are the specific terms in your parenting plan for these situations? And how did the police decide she was impaired?

Good questions. It’s important to know exactly what you’re working with.
You really should file for an emergency order ASAP. It’s the only way to protect yourself and the kids legally.

But how do you file that without a lawyer? I don’t have the cash for one right now.
@Flippa
You can usually find templates or forms online. Just make sure to serve them properly.
Definitely keep the police report. If she’s supposed to follow her treatment plan and isn’t, that’s a big issue. You might need to push for supervised visits if she can’t prove she’s okay.

But isn’t it possible she’s just having a bad moment? Maybe she’s still following her treatment?
@Fionn
Sure, but her behavior is concerning enough that you need to be cautious. It’s better to be safe.
