Conflict of interest/grievance with my attorney in New Jersey

I hired an attorney in September 2022, but I recently discovered that he was a co-defendant in a major civil suit with the opposing attorney, which was filed in January 2022. They are involved in a large case related to a school district and city police, and it’s still ongoing. I found this out after realizing my attorney failed to advocate for my child’s best interests. Now, I am responsible for the opposing attorney’s fees, and it feels like my attorney didn’t fight against it.

I’ve submitted evidence of various issues including videos, texts, lies, abuse, domestic violence, neglect, truancy, police involvement, and even CPS engagement. I’ve also found out that the opposing party has cases involving her other children. This whole situation has been incredibly frustrating.

I’ve cashed out my 401k to pay for legal fees and am currently paying $900/month in child support. I am considering representing myself (pro se) but I’m unsure if I have grounds for a conflict of interest or misconduct grievance against my attorney. I just want to ensure the well-being of the child I raised from birth. Any resources or advice would be greatly appreciated. I’ve already contacted the ABA and exhausted various forms of assistance.

You might have grounds for a grievance, especially if your attorney didn’t disclose the conflict. It’s crucial to document everything.

Consider reaching out to legal aid organizations in New Jersey. They might offer guidance or assistance for your situation.

If you decide to file a grievance, make sure you have all your evidence organized. A conflict of interest could be a serious issue for your attorney.

Going pro se can be tough, but many people have successfully navigated the system without an attorney. Make sure to use available resources like self-help centers.
