Custody question about weekends in Texas

My ex and I have a standard possession order, and she’s the custodial parent. I get first and third weekends. With January 31st coming on a Friday, I thought I would have my son for the fifth weekend of the month, which means I would also get the following weekend starting February 7. I usually get back-to-back weekends when there’s a fifth weekend. However, my ex thinks the preceding weekend counts as both the last in January and the first in February. Am I correct? Can someone link something I can show her?

In Texas, anytime there’s a fifth Friday in the month, the non-custodial parent gets two weekends in a row. For 2025, that includes January, May, August, and October. Let her know so she doesn’t have an excuse to act this way again.

You’re correct. With a fifth weekend, you get back-to-back weekends. If you search for Texas SPO calendar, the Office of the Attorney General has a calendar that shows you these weekends. It won’t include vacations or holidays but will help visualize the 1st, 3rd, and 5th weekends.

Your parenting plan should clarify which one of you is correct. Typically, weekends are defined by Saturday, but it sounds like Friday is the designated day here. If your plan isn’t clear, why not agree to split it for now? Just define it clearly going forward.

You’re right. English isn’t my ex’s first language, so I often explain things to her, and she gets suspicious when it works out in my favor. I’ll check if it stipulates Friday in the order. Thanks for the help!

No, she’s wrong. Texas standard order of possession is clear. The NCP gets the child every first, third, and fifth Friday of the month from 6 pm to 6 pm the following Sunday. If there’s a fifth Friday, the NCP gets two weekends in a row. It only happens four times a year.
