Had a Receiver Appointed, Possible Recourse?

I filed for contempt of court in February 2023 against my ex-husband, who refused to appear, leading to a warrant for his arrest. Unfortunately, the sheriff never served the warrant. I’m struggling financially because I have to cover some of the debts assigned to him during our divorce, and he’s not paying. I can’t just stop paying the loans because my wages would get garnished or a lien would be placed on my home. I asked the judge to appoint a receiver due to my ex evading his warrant, thinking it was the best solution. I won the motion, but now I’m feeling overwhelmed. My lawyer didn’t explain the risks well. The judge said I should be held harmless for my ex’s contempt, but now I’m responsible for 50% of the receiver’s fees. With the debt my ex-husband owes, I could end up paying $50,000 to $120,000, which I can’t afford on my $35k salary. My ex was awarded most assets and debts, including three businesses and tax issues, and the loan I’m paying ($800/month) isn’t included in the receiver’s authority. I feel lost and unjustly treated by the court. Can I ask for the receiver to be dismissed? Can I appeal the judge’s decision on the fees? I’ve followed the divorce decree exactly, yet I’m the one suffering.

You should tell your lawyer that it’s urgent and you need to speak with him ASAP. This is a serious situation.

I’ve tried calling him for days, but he keeps saying he’s busy. It’s really frustrating.

Have you thought about asking the court for a modification of the receivership? It’s worth a shot if you can’t afford those fees.

I didn’t even know that was an option. I’ll definitely look into it.

You might want to consult another attorney for a second opinion. Sometimes a fresh perspective can help.

That’s a good idea. I just need to find someone who can help me quickly.

I feel for you. It’s so unfair when the system doesn’t seem to support the innocent party. Stay strong.

Thanks, I really appreciate the support. It’s been tough.

If you can document everything, it might help in your case. Keep track of all communications with your lawyer and the court.

I’ve been keeping notes. I hope it helps when I finally get to talk to my lawyer.
