How can I access someone’s criminal record in California?

I’m in the process of filing a domestic violence restraining order in California against my soon-to-be ex-wife. I know she has previous charges of domestic violence involving me and other people. How can I access her criminal record to present it in court as evidence? Is this information available to the public?

To answer without personal advice—every state, including California, has a court database. You’ll need the name and probably the city she was arrested in. Just go to the specific county’s court records database, and you can search there. Each state varies, but court records are generally public information. For example, in Florida, you’d check something like this: Case Search.

Thanks for the info. It was in Orange County, California. Does that mean I need to check multiple cities?

Yes, if there were incidents in multiple cities, you might have to check each local court’s database or look up her records at the county level for the whole of Orange County. A bit tedious but worth it if it helps with your case.

Criminal records are typically public information, but keep in mind that you may not be able to use everything as evidence in court. Check the California public records page at Public Records | State of California - Department of Justice - Office of the Attorney General or look for her information at California Criminal Court Records | CaliforniaCourtRecords.us. Also, you can visit the county court in person for records access.

Thanks, this is helpful. Visiting in person might be easier. Will I need any special documentation to access these records in person?

Usually, you just need her name and some identifying info like date of birth, but each county might have slightly different requirements. It’s best to call ahead to make sure you’re bringing everything you need.

@Flynn
Good call—I’ll make sure to get in touch with them first. Appreciate the advice!
