How do I amend my divorce decree for education rights?

Hey guys, my divorce was finalized on 12/12. I represented myself since my ex never answered my petition or showed up for any hearings. He’s totally out of our child’s life—doesn’t call or visit, nothing. It’s been like this for years. I was granted sole physical and legal custody, which is great, but I just found out my son got approved for an IEP. I want to make sure there are no issues with his dad regarding this. How can I amend my decree to request sole education rights?

You might want to talk to a family lawyer about this. They can help you figure out the steps to amend your decree.

What’s an IEP? I’ve heard that term but not sure what it means.

Definitely get legal advice. Since you have sole custody, it should be easier to get those education rights.

Is there a specific form you need for that? Or do you just go through the court?

@mjvincent
IDK about forms, but I think you file a motion or something like that.

I’d suggest documenting everything about your ex’s absence. It might help your case.

Good luck with this! It sounds like you’re doing what’s best for your son. Keep us updated.

You should definitely look into the process in your state. It can vary a lot. Are you ready for a potential court appearance?

Yeah, I’m prepared for that. Just want to ensure everything is set for my son’s education.
