My ex and I want to mutually change our parenting plan. We’re basically doing the opposite of what our divorce decree stated over 2 years ago, but I need it in writing for her doctors and the school board. Neither of us lives in Marion County, FL anymore where it was finalized. We need the order completely changed and moved to Clay County, FL. Does anyone know how we can go about this? He told me to get it drawn up and he’ll sign it, so I’m trying to figure out what our next steps are.
You need to file a motion with the court to move your case to the new county. After that’s approved, you can file the new agreement in Clay County.
The first step is domesticating the current order in the new county. It’s pretty simple. Generally, you fill out a form, attach the order, and pay a filing fee. The fee can vary by county.
Once the order is domesticated, you can then file to modify custody. Since you both agree, it shouldn’t cost too much to have an attorney help you with the basics. It’s not a complicated process, but it can be tricky to explain online.
