I went to the beach with my family, had 2 cocktails, and an hour later, I was told by the meter lady to move my truck (loading only). I moved it about 20 yards away to park, and then all of a sudden I got very confused and disoriented. I didn’t know where I was, and I was starting to panic because I didn’t know where my passengers went. I realized I must have dropped them off, but I was really scared and panicking. I called my fiancé freaking out, yelling ‘where are you! where are you!’ She was trying to tell me, but I wasn’t making sense and didn’t even know where I was or what was happening. She hung up on me because I was yelling and not making sense. I sat in the parking lot for a while trying to get some clarity, then I called her again and it went to voicemail. Right then, an officer came up to my window and said he got a call that I was arguing with someone. He asked if I had anything to drink, and I told him I had. I was given a sobriety test and breathalyzer and failed. I’m diabetic, and later a Kaiser advice nurse told me I was probably going through ketosis. Should I fight this case in court? Any thoughts or advice would help!

I’ve heard that if you’re diabetic and going through something like ketoacidosis, it can mess with your breathalyzer results. I’d get a doctor’s note and make sure your lawyer knows about your condition. Could be your best defense!

Totally agree. If your breathalyzer showed alcohol but you weren’t actually drunk, it sounds like a false positive from the ketones.
