I just got an email from my attorney because our child custody order still isn’t in the system. Apparently, the judge has been on medical leave for the past 8 months, and they haven’t entered the order yet. The email said, ‘Judge XX has instructed that if we are not in receipt of your proposed Order by the 8th then our office will make scheduling arrangements for this to be addressed on the record with you and Rachel.’ So, if my ex’s attorney doesn’t send the proposed order by then, what could happen? My ex has been in contempt, and I’ve been asking to file contempt for a while now… Anyone know what this means exactly?
It sounds like if your ex’s attorney doesn’t send the proposed order by the 8th, the court might schedule a hearing to address it. If they’re in contempt, there could be a fine, but most likely, they’ll just get a warning if it’s their first time. It’s a bit of a wait-and-see situation.

Yeah, my ex had something similar happen and they just got a warning. But if it keeps happening, the judge might be stricter.

Typically, it’s just a fine or a warning, but if it continues, they might have to appear in court or face stricter penalties.
Sounds frustrating! Hopefully, your ex’s attorney gets their act together before the 8th. If not, it could drag things out longer.
I think it depends on the judge. Some are more lenient, others aren’t. If they keep missing deadlines, though, that might not go over well.
If they haven’t followed through yet, maybe reach out to your attorney and see if there’s any way to speed things up before that deadline. I’ve had delays like this before too.
